General Information

Laos is a member of the World Intellectual Property Organization (WIPO) - 1995. Trade marks and service marks can be registered in Laos under the Decree of the Prime Minister on Trademarks.

The first-to-file rule is applied for determining priority right. Use is not required at filing but a registered mark should be used within five (5) years from the date of registration to avoid eventual cancellation action due to non-use.

The term of registration is ten (10) years and may be renewed for successive ten-year periods.

Registration procedure

Laos adopted the Nice Classification System. One application can cover only one class of goods or services.

Foreign entities can file their application directly if they have a representative office in Laos or through a local representative.

Applications are examined as to form and substance within two (02) months from the filing date upon which a decision to grant the Certificate of Registration or refusal of Application shall be made.

Publication

Once granted the registration of the mark shall be published in an official newspaper.

Filing Information

The documents required for filing a trademark registration in Laos include:

  1. a notarized ◘ Power of Attorney (required at filing), signed by applicant and certified by a duly admitted public notary of the applicant's country; and
  2. twenty (20) reproductions of mark measuring no more than 80 x 80 mm; description of mark ( meanings, indication of colors).

Furthermore, applicants are required to provide the following information:

  1. full name, address, nationality of the applicant;
  2. list of goods/services, classification; and
  3. No., date and country of the first application or home registration, if any.
